Nutter Company by three reverse mortgage borrowers, all of whom had secured home equity conversion mortgages (reverse mortgages) in 2007 and 2008. Two of the borrowers had passed away and one had been forced to move out after becoming too ill to remain in the home. When the Nutter Company moved to foreclose on the properties, the mortgage holders or their estates attempted to prove that Nutter did not have the right to do so.J.B. Nutter’s original reverse mortgage paperwork stated that the company could “invoke the power of sale and other remedies permitted by applicable law … At this sale, Lender or another person may acquire the Property. This is known as ‘foreclosure and sale.’ In any lawsuit for foreclosure and sale, Lender will have the right to collect all costs allowed by law.” However, since the paperwork didn’t specifically address the lender’s “statutory power of sale,” the dispute claimed that J.B. Nutter did not have the power to foreclose on the properties following the original borrowers’ deaths or departures.The Massachusetts Supreme Judicial Court disagreed. In the Court’s January opinion, it wrote,“It matters that this is a contract for a reverse mortgage, rather than a traditional mortgage, where the borrower makes no monthly payments of principal or interest, where the lender cannot hold the borrower personally liable for the debt, and where the lender’s only recourse on default is to obtain repayment through a foreclosure sale.”Julie Moran, Esq., Senior Executive Counsel for the law firm of Orlans PC, a Legal League 100 member, handled the case for the plaintiff. Moran told DS News, “The Supreme Judicial Court reminded the parties that contractual language is deemed ambiguous and therefore construed against the drafter if it is susceptible of multiple meanings and the circumstances surrounding it don’t indicate its intended meaning. However, here the Court concluded that under Massachusetts foreclosure law there is no power of sale except the statutory power and no reasonable borrower would have expected a lender to enter into a reverse mortgage without retaining this right. Gov candidate Guadagno selects running mate with North Bergen legal practice

Kim Guadagno announced a Bergen County mayor witha North Bergen legal practice as her running mate for the governorship on Thursday.Woodcliff Lake Mayor Carlos Rendo will unite with the Republican gubernatorial nominee to face Democratic nominee Phil Murphy and former state assembly speaker Sheila Oliver in November. Rendo would serve as Lieutenant Governor if the Republican ticket is successful.He has an extensive history in Hudson County. Not only does he also work as an immigration lawyer and founding partner for Mulkay and Rendo on 79th Street, but he also grew up in Union City, according to a biography on Guadagno’s campaign website.Rendo attended Thomas A. Edison Elementary School and the now-defunct Emerson High School in the area. In 1996, he moved to West New York and worked on the city’s planning board. There, he helped guide a $800 million waterfront redevelopment project. The two sides were locked at 19-19 with 30 seconds left for the match when Telugu’s star raider Siddharth Desai attempted the final raid.UP player Sumit went out of the mat and thus Telugu got a crucial point and had almost won the game on 20-19 before an unexpected thing happened. Desai’s teammates entered the mat before the final whistle was blown, resulting in UP being given a “technical point” by match officials, leading to the match ending as a tie.Earlier, raider Siddharth Desai collected two points as Telugu were 2-1 ahead. But in the sixth minute, UP removed Siddharth as he went in for an unsuccessful raid to reduce the gap to 3-5.But within seconds, Siddharth was back on the field, after UP raider was successfully tackled by Telugu Titans even as the southern team surged 7-3 ahead. A successful raid by Monu Goyat and two successful tackles helped UP to reduce the deficit to 6-7 in the 12th minute.The two teams were locked in a neck and neck battle, even as Telugu inched ahead to 9-7. But with some good tackles and raids, UP made it 11-11 going into the break.Telugu began the second half with a successful tackle to go 12-11 ahead, but UP pulled back one to make it 12-12. UP raider Shrikant Jadhav failed under pressure as Telugu picked up a point to make it 13-12. But even Telugu star raider Siddharth faltered again as UP collected a point to make it 13-13.With just 9 minutes to go, the two sides were locked at 15-15. However, a couple of successful tackles and with Siddharth picking up a point, Telugu moved 18-15 ahead.But a timely Super Tackle by UP Yoddha followed by a successful raid helped UP Yoddha again level the scores at 18 -18. Sabar Cell Phone Connection, had gone with his wife and two sons to mosque for prayer on Sunday afternoon, after which they visited his mother-in-law, who lives in the same village.They returned home at about 20:00h, and as Sabar was about to enter his yard, he was confronted by a group of armed men dressed as Police officers, reportedly carrying high powered weapons and cutlasses but with masks over their faces.The businessman told Guyana Times that one of the men held him at gunpoint and demanded that he open the door to the house, while the others were holding his family hostage. As he opened the door, his family was forced into the house, but three armed bandits kept guard outside.Those who came into the home demanded $20 million to keep his family alive.The businessman explained that during the ordeal he was beaten as he begged the bandits not to harm his family. Rosses in mourning as Olympic hero Pa Sharkey sadly passes away……

first_imgTributes have been paid to the late, great Pa Sharkey following his death yesterday morning. Sharkey was a brilliant boxer who won a number of Irish title before he emigrated in search of employment.While he was based in Australia, Sharkey got the opportunity to represent Ireland at the Olympic Games in Melbourne in 1956. Sharkey was a major contractor in the UK, and spent most of his time in Leeds, he employed many young people from the Rosses over the years, and was one of the areas most popular characters.He was a trustee in Naomh Muire GAA club, and was also heavily involved in the redevelopment works at The Banks in the 90’s.The club paid the following tribute to him on their Facebook timeline:“It was with sadness that we learned this morning of the death of our Club trustee Pa Sharkey. Pa passed away after recent illness with his family by his side. “Pa Sharkey was prominent in the development of the Banks in the mid 1990s, something in which he took tremendous pride. He was of course an Olympian, having boxed for Ireland in the Melbourne Olympic games of 1956, something we were all proud of knowing we had such sporting history in our midst. “Pa was a major contractor in the Leeds area employing many from the Rosses and beyond. Most of all he was a great family man, husband, brother, father, uncle and grandfather to his extended family to whom we extend our condolences at this time. “The Wake will commence at 6pm tonight at his home in Mullaghderg.“Private house from 11pm. The Wake will continue tomorrow Tuesday 10am -11pm.
